GOOD TIMES FESTIVAL TERMS AND CONDITIONS OF ENTRY AND SALE

A. EVENT TERMS AND CONDITIONS OF PURCHASE AND ENTRY

These conditions are to be read in conjunction with the Merchant Terms and Conditions of Sale for Tickets as below. Good Things Festival is presented by There is a Free Lunch Pty Ltd ("Us, Our, We, the Presenter"). By purchasing this ticket you acknowledge and agree;

All conditions shown on this ticket are to be read together with all other statements or directives either shown on this ticket or displayed on Our website or at the premises.

Entry
  1. It is a condition of the liquor license that only valid ticket holders are allowed to enter the event and you may be prosecuted if you enter or attempt to enter without a valid ticket.
Age Restrictions
  1. Under 18 attendance at this event is currently subject to approval by liquor licencing authorities.
  2. Good Things Festival (GTF) is a licensed event recommended for a mature audience.
  3. GTF recommends that young people between 15 and 17 are accompanied by an adult (ie; someone over 18 who is a parent, sibling, friend or legal guardian) and each person attending must have their own valid ticket.
  4. Children between 12 and 15 must be accompanied by a parent or legal guardian and must have their own valid ticket. Note this is subject to liquor licensing approval and there is the possibility that the authorities will prevent minors will not be allowed to attend the event.
  5. The event has the capacity to be very loud, have high intensity crowd movements, bands that may use profanities in their performance and patrons drinking alcohol. Children under 12 will not be admitted as GTF cannot guarantee the health and safety of small children. It is likely that the liquor permit will also disallow children.
  6. In the event that you are assessed at entry as being under 15 years, you will be required to be accompanied by an adult or legal guardian (over 18) on entry. Your guardian will be asked to register their details and sign a waiver. If you are found at the event without the guardian, you and your guardian may be ejected from the event for breach of safety.
  7. We strongly recommend that you do not attend the show with any child under 12. If you have any questions with regard to attending the event with an infant please contact us at info@goodthingsfestival.com.au prior to attending.
Entrance to Event
  1. Photo ID is required purchase alcohol regardless of your age. It is illegal to provide minors with alcohol and anyone caught doing so may be prosecuted and ejected.
  2. Intoxicated patrons or patrons under the influence of drugs may not be admitted. It is very likely that drug detection dogs and plain-clothes drug squad detectives will be at the event.
  3. Anything that could cause harm is a prohibited item and will not be permitted entry to the venue. This includes but is not limited to bottles, cans, glass, weapons, lasers, fireworks, umbrellas, furniture, equipment, skate and surf boards, flags, poles, pets or animals, esky's or coolers, liquids, illicit drugs and alcohol. All bags and containers are subject to a full search at entry to ensure the safety of patrons. Prohibited items that are confiscated will not be returned
  4. You may bring an empty water bottle for refilling during the day. Please drink water regularly. Please wear shoes, its safer and you'll thank us for suggesting it.
  5. No recording device of any kind is allowed except a hand held digital camera or phone with a non-removable lens. Professional cameras of any kind are not allowed on site without authority from the Presenter.
  6. It is a condition of sale that you agree that the Presenter reserves the right to refuse a ticket holder admission to the event or to evict that person from the event for any reason whatsoever at the presenters absolute discretion.
  7. Entry is at your own risk.
Accessibility
  1. All venues have wheelchair access and disabled amenities, please visit the event website for details. Please see event website for accessibility and carer info.
Tickets
  1. Your tickets should be treated as cash. Except as required by law, tickets will not be replaced nor money refunded after purchase. The Presenter does not offer refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond the Presenters control.
  2. In the event of a lost ticket, contact Oztix prior to the event. Your receipt or print out of the terms and conditions are not tickets and are not valid for entry to the event.
  3. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder. If a ticket is sold or used in breach of this condition, the Presenter reserves the right to cancel the ticket without a refund. This ticket is only valid when purchased from official agents.
  4. Tickets bought from Non-official websites or other sources may be refused entry.
  5. There is a sale limit of 8 tickets per person to any of the events. Tickets will be available until sold out or until 4pm the day before the event.

At The Event
  1. Except in circumstances beyond our control, we play rain or shine.
  2. Crowd surfing, moshing, slam or circle dancing are all dangerous activities that can seriously injure other patrons and will not be tolerated.
  3. Please note there are restricted capacities at some stages and other tented structures. Once the maximum capacity is reached in these areas there will be no further admissions. Your purchase of an event ticket does not guarantee admission to these areas in such cases.
  4. In some states smoking in a public place is not permitted. It can be an offence to smoke in a public place and you risk being fined. If your State has this law We will provide a designated outdoor smoking area and We require you to use them.
  5. Except as provided by law, the Presenter and the owner and/or lessee of the venue shall not be held liable for any loss, injury or damages sustained entering or within the venue whether caused by the negligence of the Presenter or that owner or lessee or otherwise.
  6. Ticket holders consent to filming and sound recording as members of the audience.
  7. No pass outs will be issued unless otherwise advised.
  8. In the case of an emergency evacuation or situation, please follow all official directives from police security or event organisers.
  9. If you feel at any time that you or anyone else's health or safety is threatened, you should contact the nearest security guard. There are First Aid Officers on site at all times who can be contacted by security staff.
Intellectual Property
  1. The words Good Things Festival and the Good Things logo (trademark pending) and the event artwork and the artist names and logos are all copyrighted to their respective owners and cannot be used without the prior written consent of the Presenter.

B. TICKET TERMS AND CONDITIONS OF SALE

These Ticket Terms and Conditions of Sale to be read in conjunction with the Presenters Event Terms and Conditions;

Who you are buying from
  1. This website is owned and operated by There Is A Free Lunch Pty Ltd (ACN 628 092 964) trading as Good Things Festival care of PO Box 6191 Fairfield Gardens Annerley QLD 4103 ( 'We', 'Our' or 'Us'). We sell tickets offered via this website as follows;
  2. We sell tickets offered via this website as the event organisers ('Presenter') and any tickets purchased from this website are purchased from Us as the Presenter. Any dispute you have relating to an event or ticket purchase is between you and Us. In this instance Oztix is the company we have engaged to provide a software platform and related services to facilitate sales of tickets. Oztix are not selling the tickets nor acting as agent or merchant for sales of tickets or the Presenter, and the website oztix.com.au (the "Oztix Website") is owned and operated by Ticket Solutions Pty Ltd (ACN 106 907 206) t/as Oztix ("Oztix") of PO Box 6191 Fairfield Gardens Annerley QLD, Australia. If you buy tickets from the Oztix Website you are subject to Oztix's Terms and Conditions and may (or not, as the case may be) be subject to the these Terms and Conditions as follows;
  3. The Presenter nor Oztix are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.
What you are agreeing to
  1. By visiting, using or purchasing any tickets via this website you agree to be bound by these Terms and Conditions and Our and the Oztix Privacy Policy.("You", "Your")
  2. Every ticket sold through this website is also subject to:
    1. the Presenter's additional event term and conditions (please see above)
    2. any terms and conditions of the venue at which event is held (please see the venue's website); and
    3. any terms and conditions that may be printed on the ticket.
  3. The Presenter reserves the right to add, withdraw, reschedule or substitute artists and/or vary programs, prices, venues, seating arrangements and audience capacity.
Use of this Web Site
  1. Use of this website is restricted to personal use and reference only.
Conditions of Sale
  1. All Prices quoted are in Australian Dollars and include local taxes (GST).
  2. Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or usually 2 hours before doors open for the event.
  3. The Presenter reserves the right not to sell tickets to any person, agent or company.
  4. Tickets will be delivered to you by the method you select during the booking process. If tickets are sent using Registered Post or a Courier service they will only be sent to addresses where the purchaser can sign for delivery. Mail delivery option will cease to be offered 7~10 days before the event.
  5. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder.
  6. Notwithstanding these terms and conditions, if You use a "disposable" or "temporary" credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to you unless a) you can provide full details of the credit card; b) the credit card remains valid; and c) you can produce the online purchase receipt.
  7. If You are able to order a ticket before the scheduled on-sale or presale date that was not supposed to have been released for sale, then We will have the right to cancel that ticket (or the order for that ticket) and refund to You the amount that You paid. This will apply regardless of whether because of human error or a transactional malfunction of Our website or Oztix's website or other The Pleasure Garden operated systems.
  8. If You are able to order a ticket at a price that is different to the advertised price (regardless of the source of that error, and whether it was an error in a price posted on Our website or Oztiix's website or otherwise communicated to You), we will inform You as soon as possible and give You the option of reconfirming Your order at the correct price (and credit or debit Your account as applicable) or cancelling Your order.
  9. If we are unable to contact You, You agree that we may treat the order as cancelled. If You choose to cancel after You have already paid the incorrect ticket price for the tickets, You will receive a full refund from us.
  10. Note: your Credit Card statement will itemise a purchase as a charge from "There Is A Free Lunch Pty Ltd."
Refunds and exchanges
  1. The Presenter will only refund tickets in accordance with these terms and conditions and to the extent permitted by law. The Presenter or Oztix has no liability to you.
  2. We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances. We reserve the right to charge you a reasonable fee for the replacement of tickets. Please treat your tickets like cash, as we cannot replace lost tickets.
  3. As Presenter we reserve the right to alter the date, the venue and the entertainment and activities as advertised in its absolute discretion without prior notice to you including the substitution of any artist listed to appear at the event. Your entitlement to a refund in such circumstances is determined by Us as the Presenter and if you do not agree with Our decision we advise You to please contact Us directly in order to determine your eligibility for a refund.
  4. If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.
  5. If We authorise a Refund, We will refund to you the Ticket Price, the Booking Fee, the Processing Surcharge and if applicable any Delivery fees charged for and tickets were not dispatched.
  6. Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.
  7. We will post any relevant information regarding any cancelled or rescheduled events on our website when applicable. It is your responsibility to check our website for information in relation to any events.
No Show / Failure to collect tickets / Delivery fulfilment
  1. We fulfil Our commitment to you for the sale of tickets by either mailing or by emailing the ticket to you, or by making the ticket available at the door or Box Office for you to collect.
  2. If you have elected to receive the tickets by mail or email and have not received your ticket(s) prior to 48 hours of the event, please contact Oztix.
VIP Packages
  1. We may sell tickets coupled with other offerings such as VIP experiences, music, merchandise etc. (So called "Bundled Sales").
    We cannot be held liable or responsible for the non-delivery of any goods or services that have been Bundled with Tickets as we have no oversight over how the fulfilment or delivery of Bundled Sales are managed. It is a condition of sale that all claims about non-delivery of Bundled Sales must be taken up direct with the Us as Presenter. Please contact us for details in this instance.
Pay Over Time Payment Option
  1. In some circumstances you may be able to pay for your ticket over a period of time, in instalments. If both parties agree to this payment option, You agree that We can charge your credit card a deposit, a booking fee (if any) and the number of specified instalments prior to sending you a confirmed ticket.
  2. You also agree that you only have a reservation for a ticket and are not entitled to a ticket to the relevant event until full payment of the ticket and associated fees is made.
  3. If your credit card details change or expire prior to your payment of any instalment, you agree to contact Us to update your credit card details.
  4. You hereby agree that if, for any reason, We are not able to process any of the instalments on their due date, your reservation for the ticket will be cancelled and your deposit and any booking fee paid will be forfeited by you.
  5. If we cancel your order We agree to repay the instalments (other than the deposit and any booking fee) you have paid to Us to the credit card you specified at the time of selecting the pay overtime option, provided that credit card remains valid.
Changes to Terms and Conditions
  1. The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, We may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the web site.
  2. You should periodically check this page of the web site to ensure that you are aware of the latest terms and conditions.
What happens if you have an inquiry or complaint?
  1. For inquiries or complaints regarding the sale and delivery of tickets please contact us by email c/o info@oztix.com.au or telephone 1300 762 545.
  2. For inquiries or complaints regarding the staff and / or amenities at a venue or event, please contact the venue management.
  3. For inquiries or complaints regarding the artist's performance, sound or lighting or production quality, please contact the Presenter.
Data Security
  1. When We process your order We collect your credit card and personal information in accordance with Our and the Oztix Terms and Conditions, our Privacy Policy and our Privacy Collection Notice.
  2. If you are concerned about using your credit card online please contact us for assistance.
  3. If you deny or dispute a charge on your credit card made by us, please contact us immediately. We consider credit card fraud to be a serious offence and we aim to prosecute each case to the fullest extent possible.
Copyright and Trademark
  1. The images, text, logos and artwork contained within this site are copyright to Presenter, Oztix and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited. The Oztix logo is a registered trademark.
Disclaimer and liability
  1. You accept that the Internet is not always a reliable and that system outages may occur.
  2. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, We or Oztix will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your purchase of any tickets or your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not we know of the possibility of such damage.
Choice of Law
  1. These Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but legal proceedings may be commenced in any Australian State or Territory.
Australian Consumer Law
  1. Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
